5. Who else has access to the personal data and why
5.1. We may disclose and share your Personal Data with third parties, as described below:
5.1.1. Within Our Organization
AmFi may share the User's Personal Data with third parties, such as, subsidiaries, affiliates, investors and funders, or other entities of the same economic group if it considers that sharing User's Personal Data is legal, that it is in accordance with, or it is mandatory by virtue of any contractual relationship between the User and AmFi or according to the applicable legislation, regulations, or legal processes.
5.1.2. Legal and Regulatory Obligations
AmFi may, eventually, be required by law, by a court, or by an authority to disclose to the corresponding regulatory or police authority, and/or other competent authorities, certain information and Personal Data of the Users or of any agreement that AmFi has signed with the User.
5.1.3 Exercise of Rights
AmFi may also need to share User's Personal Data to exercise or apply its legal rights, including the exercise of rights in judicial, administrative, or arbitral processes, and in contracts.
5.1.4 Business partners and service providers
AmFi may share and process Users’ Personal Data with agents, vendors, consultants, or suppliers, as well as any other third-party who perform certain services on AmFi's behalf (for example, outsourced service providers, external legal advisors, financial institutions, etc.). Said third parties will have access to the User's Personal Data only to provide the services and comply with the object established in the corresponding agreement, or to comply with the applicable legislation. AmFi requires that these third parties adopt security measures that are consistent with the protections specified in this Policy and in the applicable legislation
5.1.5 Regulated Entity
AmFi may share Users’ Personal Data with the financial or payment institution holding User’s account for purposes of the Services offered by AmFi. We may also share your Personal Data with financial or payment institutions, such as banks, to provide you with the Services.
5.1.6 Corporate Transactions
AmFi may disclose Personal Data to a buyer, prospective buyer, corporate affiliate, or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding in which Personal Data held by us about our Users is among the assets transferred. You acknowledge to our assignment or transfer of rights to your personal information.
